Post-Conviction Appeals and Writs

Just because the jury returned a guilty verdict does not necessarily mean that is the final outcome. You have the right to appeal the conviction. However, because there are strict guidelines and time limits governing appeals, it is important that you hire a law firm with experience with post-conviction remedies.

At Herrmann & Weaver, Attorneys at Law, we handle state and federal misdemeanor and felony appeals and writs of habeas corpus for clients in the Texas Panhandle and New Mexico. Whether we handled your original case or you are dissatisfied with your previous law firm, we will develop a powerful appellate strategy for your situation, giving you a second chance at justice.

Our lawyers are both former felony prosecutors who are Board Certified in Criminal Law by the Texas Board of Legal Specialization. Contact us for trusted representation.

Experienced Appellate Representation

If you have been convicted of a crime in Texas, you have 30 days to file an appeal. If inadmissible evidence was presented at trial, new evidence was later uncovered or another circumstance occurred, it is critical that you speak with one of our attorneys immediately.

One of our lawyers, Walt Weaver, formerly worked as a briefing attorney where he reviewed hundreds of appellate briefs. This experience helps us create insightful briefs for our clients. We know how to look at a case from all angles and identify critical elements that can lead to a successful appeal. Not only do we know the law, but we also possess the requisite attention to detail and persuasive abilities.

Writ of Habeas Corpus

After all other appeal options have been exhausted, you have the option of filing a writ of habeas corpus. This seeks a review, reversal or new trial, usually on the basis of:

  • New evidence acquired
  • Evidence wrongfully excluded at trial
  • A violation of your constitutional rights
  • Ineffective legal representation

Writs of habeas corpus are not limited by time restrictions.
